HOWEVER in the trailer http://store.steampowered.com/app/1250/[url]http://store.steampowered.com/app/1250/[/URL] it states
"Blood And Gore, Intense Violence, Partial Nudity, and Strong Language." As long as they don't FORCE players to download the mutator they cannot be held responsible because.. I'll quote my full post since i'm lazy.

All they gotta do is update the TOS to say "We will not be responsible for any whitelisted Community Created content Or Modifications that others may find offensive, it's Solely up to the player to decide whether or not they wish to join Servers that host such Content " Problem solved. because if it's a mutator, it is ALWAYS shown on the bottom left Info box when you click ONCE on a server. Therefore TW Already provided a feature so you will be able to see if a server has "Possibly offensive" Material on it. Am i right?
TWI also cannot be held responsible for what other people host on 3rd party servers. Because they give you a choice "Join someone elses server and if you don't like it, host your own"

So personally i feel there is NO reason why this CAN NOT be whitelisted.

And i'm not saying this because i want this in particular whitelisted, But because i believe that you shouldn't censor something that people have a CHOICE to view. It's like television. regular television channels can be viewed by anyone and everyone, and is free (provided you have the equipment) and therefore it must comply with what "The Public" deem acceptable. However with Cable/Satellite channels, they aren't available for free to the public and even if they were, you'd have to sign an agreement that states you know there may be material others may find "potentially offensive". Therefore if you didn't wish to see "potentially offensive material" you can choose to decline the agreement and therefore the channels and remain with what the public finds "Acceptable"
and according to the ESRB website
