Anyways, whenever dealing with populations, assumptions have to be made based on averages. You will always find individuals that contradict the model/average/assumption. Unfortunately, if you invalidate the entire model based on the outliers, you won't have any applicable model or solutions based on the model.
In other words, to strike down a law because it's unfair to one person may be unfair to 1,000,000 people. So where do you draw the line?
